The Eleventh Yang di-Pertuan Besar of Negeri Sembilan, Malaysia.

Duli Yang Maha Mulia Tuanku Muhriz ibni Almarhum Tuanku Munawir (born 14 January 1948) is the eleventh Yang di-Pertuan Besar of Negeri Sembilan, Malaysia.

Tuanku Muhriz is the only son out of six children of the late Tuanku Munawir ibni Almarhum Tuanku Abdul Rahman, the Yang di-Pertuan Besar of Negeri Sembilan from 1960 to 1967, and of his consort, Tunku Ampuan Durah binti Almarhum Tunku Besar Burhanuddin.

Born in 1948, Tuanku Muhriz received his early education at the Tuanku Muhammad and Tunku Besar Schools in Tampin, the King George V School in Seremban, Negeri Sembilan and later at the Aldenham School in the United Kingdom.

Tuanku Muhriz obtained a degree in law (LLB) from the University College of Wales at Aberystwyth (later known as the University of Wales, Aberystwyth).

He began his career in an international bank in Malaysia and became a director and shareholder of a company licensed as brokers in interbank foreign exchange and in the currency deposits market(1973–1986). He was the chairman and shareholder of a Malaysian joint venture with a worldwide advertising agency (1981–1992), chairman and director of a joint venture company involved in the manufacturing of building products(1995–1998) and a director and shareholder of a company engaged in electrical engineering and construction (1995 to present). He has been on the board of directors of Bangkok Bank since 2006.

Tuanku Muhriz was made Tunku Besar, or heir presumptive in 1960. However, he was bypassed by the Council of Undangs Yang di-Pertuan Besar when his father died in 1967 for his uncle, Tuanku Jaafar. Tuanku Jaafar was elected by the Undangs as the 10th Yang di-Pertuan Besar of Negeri Sembilan.

The Negeri Sembilan Constitution states that the order of succession should first be the sons of the previous Ruler, followed by the grandsons of the previous Ruler, then by the brothers of the previous Ruler, and only then by the sons of the brothers of the previous Ruler.

Tuanku Muhriz was first in the order of succession before the death of Tuanku Munawir, followed by Tunku Jaafar and Tunku Abdullah. When Tuanku Munawir died, Tuanku Muhriz was not chosen. Instead the council chose his half-uncle Tuanku Jaafar ibni Almarhum Tuanku Abdul Rahman, a diplomat. It has been suggested that the then Prime Minister of Malaysia, Tunku Abdul Rahman, influenced the Undangs not to choose Tuanku Muhriz on account of his youth (he was then only eighteen).

On 29 December 2008, The Council of Undang proclaimed him as the 11th Yang di-Pertuan Besar of Negeri Sembilan succeeding Almarhum Tuanku Jaafar ibni Almarhum Tuanku Abdul Rahman who had died on 27 December 2008. It has been learnt that many prominent Malaysians had backed Tuanku Muhriz to succeed as the Ruler of Negeri Sembilan in view of his modest and dignified personality and by his having a successful corporate career.

Due to a life-long habit of keeping a low profile, Tuanku Muhriz was largely unknown outside royal circles in Negeri Sembilan. However, Tuanku Muhriz was hardly the underdog in the intense negotiations that was played out for the position of Yang di-Pertuan Besar of Negri Sembilan. During the closed discussions to elect the successor to the late Tuanku Jaafar, at least two, if not all four of the Undangs strongly championed his candidacy. They refused to budge when it was suggested that they consider Tunku Naquiyuddin, Tuanku Jaafar's eldest son, instead as the next Ruler of Negeri Sembilan.

Tuanku Muhriz has throughout his life established and maintained strong ties with the Undangs, the general nobility, the lesser royalty and people of Negeri Sembilan, and more so since moving back to the state a few years ago. He also has powerful backers within the political establishment in the state, with the former state Menteri Besar Tan Sri Isa Samad among his supporters.

There has been a quiet campaign by his loyal supporters at state and federal level to portray him as a well-spoken and well-educated man; someone who had the great strength of character to put aside the disappointment of not being appointed Ruler of the state in 1967: and who continues to lead a dignified and respectable life.

His supporters said that in contrast to members of Tuanku Jaafar's family, Tuanku Muhriz shuns publicity and though he can be very progressive in his outlook, he seems more rooted in traditional ways. Tuanku Jaafar's family are said to be completely devastated with the decision of the Undangs to select Tuanku Muhriz over Tunku Naquiyuddin. They too had several powerful politicians in their camp but the Undangs were not to be swayed.

Tuanku Muhriz is married to Terengganu princess Tengku Datuk Aishah Rohani Tengku Besar Mahmud and the royal couple have three sons: Tunku Ali Redhauddin Muhriz, Tunku Zain Al’Abidin Muhriz, and Tunku Alif Hussein Saifuddin Al-Amin.

Jamuan Hari Raya Aidilfitri 1430 Hijrah UDM





Universiti Darul Iman Malaysia (UDM) dengan kerjasama Jabatan Kebudayaan, Kesenian dan Warisan Negeri Terengganu telah mengadakan Jamuan Hari Raya dan Program Merakyatkan Seni Budaya pada 9 hingga 10 Oktober 2009.

Majlis penyembelihan dua ekor lembu dan dua ekor kerbau telah diadakan pada petang 9 Oktober manakala pada sebelah malamnya telah diadakan persembahan wayang kulit.

Pada pagi keesokan harinya pula, majlis yang diadakan di Dataran Asrama Baru, UDM Kampus KUSZA telah dimulakan dengan acara sukaneka yang disertai oleh pelajar-pelajar UDM.

Antara acara yang dipertadingkan ialah bowling kelapa, tarik tali, lumba lari terbalik, congkak, dam haji, lari dalam guni dan galah panjang.

Majlis jamuan hari raya pula bermula pada pukul 12 tengahari yang dihadiri oleh Naib Canselor UDM, Dato’ Prof. Dr. Alias Daud, Timbalan Naib Canselor (TNC) Akademik & Antarabangsa, Prof. Dr. Mohd Afandi Muhamad, TNC Penyelidikan & Inovasi, Prof. Dr. Abdul Manaf Ali, Pendaftar, Nurul Huda Muda dan Bendahari, Baharin Salim.

Majlis jamuan itu juga telah dihadiri oleh kakitangan dan pelajar UDM.

Pada sebelah malam pula, para hadirin telah dihiburkan dengan persembahan oleh kumpulan De-Mahameru, dikir barat, nyanyian dan persembahan tarian.

Delegation At Indonesia

A delegation was sent for a formal discussion with the representatives of Universitas Indonesia and Universitas Parahyangan Katolik on 22nd May to 25th May 2009. This trip was organized by the Mooting and Client Counseling Exco. A total of 16 delegations, including 13 students and 3 lecturers were involved in this discussion. At the Universitas Indonesia, the delegations were given an opportunity to meet the best Mooter, Miss Hanna Azkiya and the Mooting Society, International Law Moots Society (ILMS). There, the delegates were given an introduction with the history of the society, along with their aims and ways of conducting their preparation for mooting competitions. Next, they were given a talk with Hanna Azkiya, who gave a multimedia presentation of videos of their international Mooting competitions. They were also brought around the law faculty to see how they operate.
At the Universitas Parahyangan Katolik, Bandung, the Dean of the Law faculty, the Mooting alumni and also the Mooters of the faculty held an informal talk and Q&A session to share their invaluable experiences of being participants of international mooting competitions.
This trip had been successfully organized as all the aims were fulfilled. The delegation had managed to create an international relationship with these two universities and also gained a lot of useful and crucial knowledge on Mooting.
The Exco, on behalf of the delegation, would like to express their utmost gratitude to the HEPA, FUHA, FLAIRSOC, and also those who contributed sponsors for this trip.

Di bawah ialah teks perutusan Hari Kebangsaan yang saya sampaikan sempena 52 tahun Malaysia merdeka.


PERUTUSAN HARI KEMERDEKAAN OLEH YAB DATO’ SRI MOHD NAJIB BIN TUN ABDUL RAZAKPERDANA MENTERI MALAYSIA PADA 30HB OGOS 2009 (AHAD), JAM 9 MALAM




BismillahirahmannirrahimAssalamualaikum Warahmatullahi Wabarakatuh dan salam 1Malaysia.Tuan-tuan dan Puan-Puan,



1. Alhamdulillah, pertama sekali marilah kita semua mengucapkan rasa syukur ke hadrat Allah S.W.T justeru di atas rahmat dan limpah izinNya jua, esok sekali lagi kita akan menyambut hari kebangsaan kali ke-52 dengan tema 1Malaysia Rakyat Didahulukan Pencapaian Diutamakan.


2. Lima puluh dua tahun yang lalu, sekumpulan patriot negara yang diterajui oleh YTM Tunku Abdul Rahman Putra al-haj telah berjaya mencapai kemerdekaan negara setelah hampir lima kurun berada di bawah belenggu penjajahan.


3. Pasca kemerdekaan kemudiannya menyaksikan tugas dan tanggungjawab untuk menentukan arah tuju tanah air yang satu ketika dahulu berada di dalam genggaman penjajah telah beralih ke tangan anak watan.


4. Dengan pengalaman berkerajaan sendiri begitu singkat, berlatar belakangkan pula pemberontakan komunis yang masih belum reda, wujudnya ketidakseimbangan sosioekonomi yang meluas di tambah lagi dengan sifat majmuk negara baru, maka banyak pihak kala itu yang meramalkan bahawa Malaya ibarat retak menanti belah dan tidak mungkin berjaya.


5. Namun begitu, kita telah membuktikan bahawa sangkaan tersebut meleset sama sekali. Di dalam tempoh lima dekad merdeka kita telah berjaya muncul sebagai negara membangun yang termaju. Kita telah menjadi negara pertama di dunia yang berjaya mengalahkan pemberontakan komunis di samping kita juga berjaya mewujudkan keadilan sosial dengan rasa kehakmilikan saksama hanya dalam tempoh masa amat singkat yakni dua generasi sahaja.

6. Apakah formula rahsia yang telah mendasari kejayaan ini? Sesungguhnya, tidak lain dan tidak bukan, ia adalah faktor perpaduan di antara rakyat berbilang kaum dan kepercayaan yang berteraskan kepada falsafah meraikan kemajmukan yang wujud sebagai sumber kekuatan bukannya perkara titik bengik yang menyebabkan perpecahan.


7. Sayangnya , masa yang berguling telah menyaksikan jambatan dibina oleh bapa-bapa kita dahulu dengan segala susah payah telah mula digoyahkan oleh golongan tertentu yang cuba menangguk di air keruh. Mereka telah mengeksploitasikan garis-garis gelinciran yang wujud dalam masyarakat berbilang kaum sama ada ianya bersifat politik, agama mahupun sosial demi untuk memuaskan agenda sempit mereka.


8. Di persimpangan ini, cabaran terbesar rakyat Malaysia ialah untuk membaik pulih jambatan yang sedia ada di samping meruntuhkan tembok-tembok pemisah antara sesama kita. Pokoknya, kita perlu terus mengurus kejayaan, membina di atas apa yang ada dengan membajai dan menyuburkan kerukunan terpupuk selama ini. Beringatlah, apa yang ada tidak semestinya akan bertambah baik malah akan musnah jika kita tidak berwaspada. Buktinya, lipatan sejarah dunia sarat dengan catatan bahawa kejayaan yang tidak diurus dengan baik akan berakhir dengan kegagalan.


9. Benarlah kata orang, yang pipih tidak datang melayang, yang bulat tidak datang bergolek. Sehubungan itu, saya ingin berpesan kepada semua terutamanya generasi muda bahawa nikmat yang kita sedang kecapi hari ini tidak terhasil begitu sahaja tanpa perancangan yang rapi, pelaksanaan yang cekap dan pengorbanan yang tinggi.


10. Kejayaan ini hasil perjuangan, keringat, air mata dan darah para wira serta para wirawati negara sama ada yang di dendang atau pun tidak. Ia dibangunkan oleh pendahulu-pendahulu kita yang lampau. Ia dipertahankan oleh anggota pasukan keselamatan yang sanggup berkorban apa sahaja hatta nyawa. Ia disuburkan oleh para murabbi dan pendidik yang gigih berjuang di kelas-kelas dan bilik kuliah. Ia dimakmurkan oleh wira swasta, wira korporat, para penjaja, waima peniaga kecil yang gigih dengan semangat keusahawanan mereka mencipta kemakmuran. Tuntasnya, ia dilincirkan pula oleh para penjawat awam yang gigih berkhidmat.


11. Nyatanya, kejayaan dan kemakmuran Malaysia sepanjang ini tumbuh dan berkembang hasil sumbangan serta dokongan semua kaum, semua penganut kepercayaan, semua lapisan masyarakat, di desa mahupun di kota, yang berada ataupun tidak, tua atau muda. Kendati itulah, saya ingin tegaskan bahawa setiap seorang daripada kita mempunyai peluang yang terbentang di bawah langit Malaysia. Yang membataskan pencapaian masing-masing hanyalah kemahuan untuk berjaya, kesanggupan untuk bekerja keras dan keberanian untuk mengambil risiko. Tuan-Tuan dan Puan-Puan,


12. Di atas segala, sepanjang lebih lima dekad Malaysia telah melalui pelbagai detik dan panca peristiwa. Segalanya, dilalui penuh dengan suka duka, pahit manis dan jatuh bangun bersama dalam kemajmukan.


13. Bertitik tolak dari kepahitan mengharungi ganasnya Bintang Tiga, keperluan monumental mengisi erti kemerdekaan bitara yang dicapai tanpa pertumpahan darah, kepincangan sosioekonomi, keretakan hubungan kaum tanggal 13 Mei 69, kemelesetan ekonomi 80an dan krisis kewangan Asia hujung 90-an. Semuanya telah kita tempuhi dan semuanya telah kita redahi dengan jaya. Ternyata walau apa pun, harus diinsafi bahawa kita tidak mampu bernostalgia dengan kejayaan lalu tanpa berusaha mencipta kejayaan-kejayaan baru.


14. Lantaran itu, untuk menentukan hari esok lebih baik dari hari ini kerajaan telah pun memperkenalkan dasar-dasar yang lebih ampuh dan mampu menjulang kita menjadi sebuah negara yang maju. Sebermula pentadbiran saya telah diutarakan konsep 1Malaysia yang berpaksi kepada Perlembagaan Persekutuan dan Rukun Negara sebagai teras hala tuju matlamat kerajaan. Law and Justice are at Best Just Distance Cousins

So goes the infamous quote that most lawmakers and practitioners could not and would not challenge. Many in the legal world would tell me, “When you study, your perspective of law itself is formed; and when you go out and involve yourself in law, your perspectives turn 180 degrees.” The truth is, I couldn’t help but think of what is the purpose of reading law when the real practice is that most of the time, these theoretical elements we hammer into our heads day and night are just pure theories and nothing else. I suddenly lost my faith in the system and what it represents. Pessimistic? You bet I am.

In a way, doing my attachment at the High Court had given so many information on the lawyer’s life….too much, in fact. I would say that practicing law is not for the faint-hearted, that lawyers are hated very much due to certain reasons and law and order could disturbingly be twisted and turned in certain angles and circumventing it could result in a criminal walking free. An independent judiciary is the way to go….so stressed in the lectures we attend, that is. In practice? I am not so sure. Is the police force as honest as is portrayed in the media or is the media controlled, too? Sometimes I really loved looking at policemen patrolling roads and streets with the feeling that I am secure under their surveillance, and sometimes I hear the terrible things that they

have allegedly done, I have no idea if I should trust them or not. What about the lawyers, public prosecutors, judges and the like? Law enforcers and law practitioners. “Lawyers are liars,” goes people’s perspectives. Never follow the book, it looks like.
And then came this revelation: Nothing ever comes out the way we expect it to. In Medicine, they learn about all the arteries and muscles and bones when in practice, they had to slice people up and tell people what kind of mess they are in by using their instincts and what experience they had. In teaching, what knowledge you had didn’t really matter as much as the way you attract your students to engage with you and listen to even 30 percent of the words you said. At the end of the day, in the judiciary, thousands of other criminals are waiting, usually years, in the prison for the fateful delivery of judgment that is supposed to rehabilitate, deter and be retributive at the same time to the criminals and other would-be criminals in the world. A further ponderings-on on the judgments would inadvertently lead to backlog of cases. And what about those who are wrongfully detained? And how many of us had the integrity to turn away a substantial amount of bribe when all we had to do is turn a blind eye to pocket the money? Not many, is my guess. And yet the system goes on for centuries and people still live on.
Recapitulating: I know that reading law gives me the impression that the legal world is so sunny, where policemen nab the bad guy, a lawyer represent him to see if his acts made sense by investigating every minutiae of his mind or body, and the judge sent him to prison to change him into a better man. In reality it is not. What kind of reality is what we learnt, anyway? This is why skills, experiences and guts come first, not stupidly playing with the books alone. Perhaps this is why these attachments are compulsory. Maybe to give us a brain space and see if we are up to it or not. Not up to it? Then pick up your stuff as fast as you can and leave.
And then the big c-word. To be honest, in my opinion, the Law leaves little space for corruption because one such offense and the whole purpose and meaning of law itself crumbles. Unfortunately, not everybody cares. And what could we do? We couldn’t even promise to not engage in it because circumstances change and human beings are such weak, weak people when it comes to uprightness. Law enforcements could only do so much, as was proven, and with it comes the flaw. One could only pray that he will not fall prey to the hands of Injustice.

So? Do I continue my Law Lexis Bachelor and hope that I could be the force that would change how the law works and make law and justice turn into sisters, not mere distant cousins? Despite of people’s skepticism of law practitioners, I will remain, forevermore, in conviction that the law is might and that a criminal will be punished even if he escaped from the arms of law. There I such a thing as retribution, you know. What we give, we get back. With this belief, where do I start in cultivating my faith? Definitely, through learning about it all I can and hope that, with this comparatively small knowledge I have, I will be able to uphold that thing called justice. May God help me find my way. In fact, may God tell those (me included) who are not cut-out to become law practitioners, to ditch the idea of studying law in the first place.

Differences Between Islamic Banking and Conventional

One must refrain from making a direct comparison between Islamic banking and conventional banking (apple to apple comparison). This is because they are extremely different in many ways. The key difference is that Islamic Banking is based on Shariah foundation. Thus, all dealing, transaction, business approach, product feature, investment focus, responsibility are derived from the Shariah law, which lead to the significant difference in many part of the operations with as of the conventional
The foundation of Islamic bank is based on the Islamic faith and must stay within the limits of Islamic Law or the Shariah in all of its actions and deeds. The original meaning of the Arabic word Shariah is 'the way to the source of life' and is now used to refer to legal system in keeping with the code of behaviour called for by the Holly Qur'an (Koran). Amongst the governing principles of an Islamic bank are :
* The absence of interest-based (riba) transactions;
* The avoidance of economic activities involving oppression (zulm)
* The avoidance of economic activities involving speculation (gharar);
* The introduction of an Islamic tax, zakat;
* The discouragement of the production of goods and services which contradict the Islamic value (haram)
On the other hand, conventional banking is essentially based on the debtor-creditor relationship between the depositors and the bank on one hand, and between the borrowers and the bank on the other. Interest is considered to be the price of credit, reflecting the opportunity cost of money.
Islamic law considers a loan to be given or taken, free of charge, to meet any contingency. Thus in Islamic Banking, the creditor should not take advantage of the borrower. When money is lent out on the basis of interest, more often that it leads to some kind of injustice. The first Islamic principle underlying for such kind of transactions is "deal not unjustly, and ye shall not be dealt with unjustly" [2:279] which explain why commercial banking in an Islamic framework is not based on the debtor-creditor relationship.
The other principle pertaining to financial transactions in Islam is that there should not be any reward without taking a risk. This principle is applicable to both labor and capital. As no payment is allowed for labor, unless it is applied to work, there is no reward for capital unless it is exposed to business risk.
Thus, financial intermediation in an Islamic framework has been developed on the basis of the above-mentioned principles. Consequently financial relationships in Islam have been participatory in nature.
Lastly, for the interest of the readers, the unique features of the conventional banking and Islamic banking are shown in terms of a box diagram as shown below:-


Conventional Banks Islamic Banks
1. The functions and operating modes of conventional banks are based on fully manmade principles.
1. The functions and operating modes of Islamic banks are based on the principles of Islamic Shariah.
2. The investor is assured of a predetermined rate of interest. 2. In contrast, it promotes risk sharing between provider of capital (investor) and the user of funds (entrepreneur).
3. It aims at maximizing profit without any restriction. 3. It also aims at maximizing profit but subject to Shariah restrictions.
4. It does not deal with Zakat. 4. In the modern Islamic banking system, it has become one of the service-oriented functions of the Islamic banks to be a Zakat Collection Centre and they also pay out their Zakat.
5. Lending money and getting it back with compounding interest is the fundamental function of the conventional banks. 5. Participation in partnership business is the fundamental function of the Islamic banks. So we have to understand our customer's business very well.
6. It can charge additional money (penalty and compounded interest) in case of defaulters. 6. The Islamic banks have no provision to charge any extra money from the defaulters. Only small amount of compensation and these proceeds is given to charity. Rebates are give for early settlement at the Bank's discretion.
7. Very often it results in the bank's own interest becoming prominent. It makes no effort to ensure growth with equity. 7. It gives due importance to the public interest. Its ultimate aim is to ensure growth with equity.
8. For interest-based commercial banks, borrowing from the money market is relatively easier. 8. For the Islamic banks, it must be based on a Shariah approved underlying transaction.
9. Since income from the advances is fixed, it gives little importance to developing expertise in project appraisal and evaluations. 9. Since it shares profit and loss, the Islamic banks pay greater attention to developing project appraisal and evaluations.
10. The conventional banks give greater emphasis on credit-worthiness of the clients. 10. The Islamic banks, on the other hand, give greater emphasis on the viability of the projects.
11. The status of a conventional bank, in relation to its clients, is that of creditor and debtors. 11. The status of Islamic bank in relation to its clients is that of partners, investors and trader, buyer and seller.
12. A conventional bank has to guarantee all its deposits. 12. Islamic bank can only guarantee deposits for deposit account, which is based on the principle of al-wadiah, thus the depositors are guaranteed repayment of their funds, however if the account is based on the mudarabah concept, client have to share in a loss position..

Annual Dinner & Excellent Student Award




On the 3rd of April 2009, FLAIR held an Excellent Student Award Ceremony and Dinner
At Permai Inn Kuala Terengganu. The ceremony was attended by all law students and was inaugurated by YBhg. Dato’ Prof. Dr. Alias Bin Daud, The Vice Chancellor of UDM. We also had the honour of receiving The YBhg. Prof. Afandi, The Deputy Vice Chancellor (Academic and International), The Head Registrar of UDM, The Head Legal Committee of Terengganu, The Deans of faculty in UDM and also Madam Noraida Binti Harun (Ummi), The Deputy Dean of FUHA and now as a Dean. Also present were lecturers, faculty staffs, MT and FLAIRSOC Excos.
The tentative of the program is as followed:
1.Speech from Deputy President of FLAIRSOC, part 6 representative student and Deputy Dean of FLAIRSOC.
2.Inaugural speech from The Vice Chancellor of UDM.
3.Dean List Award for the diploma and degree student.
4.Award - giving for Most Famous Lecturer, Most Famous Mentor and Most Famous Staff of FLAIRSOC.
5.Special award for Mr. and Mrs. Smart Student and Lucky Draw.
6.Performance from representative of degree part 2,4 and 6 and diploma part 2.
7.Photography session.
The purpose for this ceremony is to appreciate the excellent student in semester 1 2008/2009, to celebrate part 6 diploma students and as an annual program of FLAIRSOC. It was handled as a whole by part 4 diploma student and by the assistance of Student University Association FLAIRSOC.

On 15th of March 2009, the degree students and diploma students from part 2 paid a visit to Kuala Terengganu Court Complex. This visit was organized by Seranta Bureau of FLAIRSOC. Some of the activities were:
